These Terms and Conditions govern the use of CorkLayer.com and the purchase of products from CorkLayer.com.

By accessing our website, placing an order, requesting a quote or purchasing from us, you agree to these Terms and Conditions. Please read them carefully before using the website or placing an order.

2. Scope of these Terms

These Terms apply to:

  • consumer purchases made through CorkLayer.com;
  • business purchases;
  • B2B, wholesale, distributor and partner orders;
  • custom project orders;
  • sample orders;
  • requests for quotes and commercial proposals;
  • use of our website, content, forms and services.

Specific written agreements, invoices, quotes, proforma invoices, wholesale agreements, distributor agreements or project contracts may include additional or different terms. In case of conflict, the specific written agreement will prevail for that specific transaction, to the extent permitted by applicable law.

3. Customers and eligibility

We sell to consumers, businesses, professionals, distributors, partners and project customers.

By placing an order, you confirm that:

  • you are at least 18 years old or have legal authority to enter into a contract;
  • the information provided at checkout is accurate, complete and current;
  • you are authorised to use the payment method provided;
  • if ordering on behalf of a company, you have authority to bind that company.

4. Products

CorkLayer is a premium modular cork flooring product made in Portugal by CorkMart.

Product descriptions, specifications, images, videos, technical information and prices are provided in good faith. We make reasonable efforts to ensure that all information is accurate, but minor differences may occur.

Because cork is a natural material, variations in colour, grain, tone, texture, density, pattern and appearance may occur. These natural variations are part of the character of cork and are not considered defects.

Product images are for illustrative purposes. Actual product appearance may vary depending on lighting, screen settings, production batch and natural cork characteristics.

5. Intended use and installation responsibility

CorkLayer products are designed for indoor modular flooring applications, subject to the product specifications and instructions provided.

The customer is responsible for checking whether the product is suitable for the intended space, use, substrate, humidity conditions, temperature conditions and installation environment before installing or using it.

CorkLayer products should be installed only on suitable, clean, dry, stable and level surfaces. Installation on unsuitable, uneven, wet, contaminated, unstable or outdoor surfaces may affect performance and may void warranty coverage.

Unless expressly stated otherwise in writing, CorkLayer products are not intended for:

  • permanent outdoor exposure;
  • areas with standing water or constant water exposure;
  • industrial heavy-duty use;
  • high-heat environments not compatible with cork materials;
  • installation over wet, unstable, contaminated or uneven substrates;
  • use with adhesives, coatings or chemicals not approved by us;
  • use contrary to the product instructions.

We recommend ordering a Sample Tile before purchasing larger quantities, especially for professional, design, hospitality, wellness, studio, school or commercial projects.

6. Product measurements, coverage and pack sizes

Product measurements and coverage information are approximate and may be subject to normal manufacturing tolerances.

The customer is responsible for measuring the installation area and ordering sufficient material. We recommend allowing extra material for cuts, edges, layout adjustments, damaged pieces, future replacement needs and natural batch variations.

For large or professional projects, we recommend contacting us before ordering so that we can help estimate quantities and logistics.

7. Prices and currency

Prices are displayed on CorkLayer.com and may vary depending on market, currency, promotions, taxes, shipping destination or other applicable settings.

Our primary store currency is EUR. Depending on Shopify Markets, payment provider availability or customer location, prices may be displayed or charged in other currencies.

We reserve the right to change prices, promotions, shipping rates and product availability at any time for future orders. Confirmed orders will not be affected by later price changes, except where an obvious pricing, technical or display error occurred.

8. Taxes, duties and import charges

Prices may include or exclude taxes depending on the customer’s location, applicable law, checkout settings and market configuration.

Orders shipped within the European Union are generally processed under EU rules.

Orders shipped outside the European Union may be subject to customs duties, import VAT, tariffs, brokerage fees, clearance fees, local taxes or other charges imposed by the destination country or carrier.

Unless expressly stated otherwise at checkout or in writing, international orders outside the European Union are shipped on a DAP / duties and taxes unpaid basis. This means the customer is responsible for all applicable import duties, taxes, customs clearance charges and local fees.

CorkLayer cannot control or predict customs charges. Customs rules vary by country and may change without notice.

9. Orders

When you place an order, you are making an offer to purchase the selected products under these Terms.

An order is accepted only when we confirm it, process payment and prepare it for fulfilment. We reserve the right to reject, cancel or limit any order where permitted by law, including in cases of:

  • pricing errors;
  • stock errors;
  • payment failure or suspected fraud;
  • incorrect customer information;
  • shipping restrictions;
  • unavailable delivery options;
  • suspected misuse of promotions;
  • orders that appear to be placed for unlawful, unsafe or abusive purposes.

If we cancel an order after payment has been made, we will refund the amount paid for the cancelled order, unless a different remedy is agreed or legally required.

10. Payment

Available payment methods are shown at checkout.

Current payment options may include Revolut, card payments, wallet payments and, where available, Scalapay for eligible European customers.

Payment methods may vary by country, order value, customer eligibility, payment provider rules and Shopify settings.

Bank transfer for B2B, wholesale, distributor or project orders may be available upon request and subject to approval.

Orders paid by bank transfer may not be processed or reserved until funds are received and confirmed.

We do not store full payment card details. Payments are processed by third-party payment providers according to their own security standards and terms.

11. Scalapay and third-party payment providers

If you choose Scalapay or another third-party payment provider, additional terms, approval criteria, payment schedules, fees, reminders or credit conditions may apply directly between you and that provider.

CorkLayer is not responsible for payment provider approval decisions, instalment schedules, late fees, credit checks, account restrictions or other provider-specific terms.

Refunds for orders paid through third-party payment providers are processed according to the payment provider’s procedures and may take additional time to appear in your account.

12. Shipping and delivery

Shipping and delivery are governed by our Shipping Policy, which forms part of these Terms.

All orders are prepared and dispatched from Portugal.

For deliveries within Portugal and Spain, we usually ship with CTT Expresso or GLS. For the rest of the world, our main logistics partner is UPS. Depending on destination, service availability, parcel size, operational constraints or customs requirements, we may also ship with DHL, FedEx or another reputable logistics partner.

All CorkLayer shipments are sent with tracking and transport insurance according to the selected carrier’s conditions.

Large orders may be shipped in multiple boxes or multiple shipments.

13. Address accuracy and failed delivery

The customer is responsible for providing a complete and accurate shipping address, email address and phone number.

If an order cannot be delivered because the address is incorrect, incomplete, inaccessible, refused, unclaimed or because the customer failed to follow carrier or customs instructions, the customer may be responsible for additional costs, including:

  • address correction fees;
  • return-to-sender fees;
  • reshipping costs;
  • storage fees;
  • customs return charges;
  • carrier handling fees;
  • non-recoverable import or brokerage charges;
  • damage or loss caused by failed delivery or return transport.

For consumer orders where a statutory right of withdrawal applies, we will not apply a penalty for exercising that legal right. However, the customer may remain responsible for return shipping costs and for any loss in value caused by handling beyond what is necessary to inspect the product, in accordance with applicable law.

14. Sample Tile and sample credit

The CorkLayer Sample Tile is intended to help customers evaluate the material, colour, thickness, texture and finish before ordering larger packs.

If you purchase a Sample Tile and later purchase a full CorkLayer pack, we may credit the Sample Tile product value back to your future order according to the promotion active at the time.

Unless otherwise stated in writing:

  • the sample credit value is limited to the Sample Tile product price;
  • shipping fees paid for the Sample Tile are not included in the credit;
  • the sample credit is valid for 180 days from the Sample Tile purchase date;
  • the sample credit may be used only towards a future full CorkLayer pack purchase;
  • the sample credit cannot be exchanged for cash;
  • the sample credit cannot be combined with all promotions unless expressly allowed.

15. Promotions, discounts and special offers

Promotions, discount codes, sample credits, free shipping offers and special campaigns are subject to the conditions stated at the time of the offer.

Promotions may be limited by time, country, product, order value, customer type, quantity or other eligibility criteria.

We reserve the right to refuse, cancel or reverse promotions where there is misuse, fraud, technical error, duplicate use, unintended stacking of discounts or breach of promotional conditions.

Discounted products remain subject to mandatory consumer rights. However, voluntary return benefits, extended return periods, additional promotional credits or non-statutory return privileges may not apply to discounted, clearance, final-sale, B2B, wholesale, distributor or custom project orders.

16. Order cancellation before dispatch

If you need to cancel an order, contact us as soon as possible at info@corklayer.com.

If the order has not yet been prepared, packed, booked with the carrier, collected or dispatched, we will try to cancel it and issue a refund.

If the order has already been prepared, packed, booked with the carrier, collected or dispatched, it can no longer be cancelled as a pre-dispatch cancellation. In that case, the return or withdrawal process may apply, depending on the type of customer and order.

17. Consumer right of withdrawal

For eligible consumer orders placed online, customers in Portugal and the European Union have a statutory right to withdraw from the purchase within 14 days from the day they, or a third party indicated by them other than the carrier, receive the goods.

To exercise the right of withdrawal, the customer must clearly inform us within the applicable period by contacting info@corklayer.com.

The customer does not need to give a reason for exercising the statutory right of withdrawal, but we may ask for feedback to improve our products and service.

The statutory right of withdrawal applies only to eligible consumer purchases and does not apply in the same way to B2B, wholesale, distributor, partner, professional or custom project orders.

18. Effects of withdrawal

Where the statutory right of withdrawal applies and is validly exercised, we will reimburse eligible payments according to applicable law.

Where required by applicable law, this may include the standard outbound delivery cost paid by the customer, but does not include additional costs resulting from the customer choosing a delivery method more expensive than the least expensive standard delivery method offered by us.

Unless we offer to pay return shipping or unless applicable law requires otherwise, the customer is responsible for the direct cost of returning the goods.

We may withhold reimbursement until we have received the goods back or until the customer has supplied evidence of having sent the goods back, whichever occurs first, where permitted by law.

Refunds will be issued using the same payment method used for the original transaction, unless otherwise agreed and permitted by law.

19. Product inspection, installation and loss of value

The customer may inspect the product with reasonable care, similar to what would normally be allowed in a physical store, to establish its nature, characteristics and functioning.

Opening the package and visually inspecting the product is generally acceptable. However, installing the product as flooring, walking on it beyond reasonable inspection, cutting it, gluing it, staining it, damaging it, modifying it, exposing it to unsuitable conditions or returning it incomplete may go beyond what is necessary to inspect the product.

CorkLayer tiles that have been installed, used as flooring, walked on beyond reasonable inspection, cut, glued, altered, stained, scratched, damaged, exposed to unsuitable conditions or returned incomplete may suffer a deduction for diminished value, up to the full value of the product where the product can no longer be resold as new or where permitted by law.

We do not classify CorkLayer as a personal hygiene product. However, installed, used, damaged, altered or incomplete flooring products may not be accepted for resale as new and may be subject to a reduction in refund value where permitted by law.

20. Return conditions

Returned products must be sent back in suitable packaging and, whenever possible, in the original packaging.

The customer must take reasonable care to protect the goods during return transport.

For CorkLayer flooring products, returned items should be:

  • clean;
  • dry;
  • complete;
  • unmodified;
  • not installed;
  • not cut;
  • not glued;
  • not stained;
  • not damaged;
  • returned with all included components, if applicable.

If goods are returned damaged due to poor packaging, improper handling or unsuitable return transport, we may deduct the loss in value or reject the return where permitted by law.

21. Restocking and handling fees

No restocking fee is applied to consumers for exercising a statutory right of withdrawal where such a fee would not be permitted by applicable law.

For non-consumer orders, B2B orders, wholesale orders, distributor orders, partner orders, project orders, refused deliveries, failed deliveries, non-collected parcels, customer-caused return-to-sender cases, or voluntary returns accepted outside the statutory withdrawal period, we may apply a reasonable restocking, handling, repacking, inspection or logistics fee where permitted by law and where communicated before acceptance of the return.

Any applicable restocking or handling fee will depend on the condition of the goods, order size, packaging condition, inspection needs, repacking requirements, logistics costs and whether the goods can be resold as new.

22. Exceptions to returns and withdrawal

The statutory right of withdrawal may not apply, or may be limited, in cases provided by applicable law.

Unless mandatory law states otherwise, the following orders are not eligible for voluntary return or cancellation after acceptance, production, preparation or dispatch:

  • B2B orders;
  • wholesale orders;
  • distributor orders;
  • partner orders;
  • custom project orders;
  • made-to-order products;
  • custom-cut products;
  • custom quantities produced or prepared specifically for the customer;
  • orders governed by a specific written quote or contract that states different return conditions.

This does not affect mandatory rights relating to defective goods, transport damage accepted under the applicable process, or rights that cannot be excluded by law.

23. B2B, wholesale, distributor and project orders

B2B, wholesale, distributor, partner and project orders are commercial transactions and may be subject to separate written terms, quotes, invoices, payment conditions, minimum order quantities, lead times, logistics conditions and return rules.

Unless expressly agreed in writing or required by mandatory law, B2B, wholesale, distributor, partner and custom project orders are final and non-returnable, except in cases of confirmed manufacturing defect, confirmed order error by us or another remedy agreed in writing.

For B2B and project orders, the customer is responsible for verifying product suitability, quantities, installation requirements, technical requirements, site conditions, project deadlines and regulatory requirements before placing the order.

We may require advance payment, deposit payment, bank transfer, signed quote approval or written confirmation before processing B2B, wholesale, distributor or project orders.

24. Warranty

CorkLayer offers a 5-Year Limited Manufacturer Warranty against manufacturing defects, subject to the conditions and exclusions below.

This warranty applies to manufacturing defects existing in the product and does not cover damage, deterioration, misuse, normal wear or issues caused by installation or environmental conditions.

The warranty period begins on the date of purchase.

25. Warranty exclusions

The warranty does not cover:

  • normal wear and tear;
  • natural variations in cork colour, texture, grain or appearance;
  • minor dimensional tolerances;
  • damage caused by incorrect installation;
  • installation on unsuitable, wet, uneven, unstable or contaminated surfaces;
  • damage caused by cutting, gluing, coating, painting or modifying the product;
  • damage caused by water accumulation, flooding, excessive humidity or unsuitable moisture conditions;
  • outdoor exposure unless expressly approved in writing;
  • damage caused by excessive heat, direct heat sources or unsuitable underfloor heating conditions;
  • damage caused by heavy furniture, sharp objects, pets, wheels, dragging objects or improper use;
  • stains, scratches, dents, marks or surface damage caused by use;
  • use in industrial, commercial or high-traffic settings not approved for the product;
  • damage caused by cleaning chemicals or methods not recommended by us;
  • damage caused during transport if not reported according to our Shipping Policy;
  • products purchased from unauthorised sellers;
  • products without valid proof of purchase.

26. Warranty remedies

If a manufacturing defect is confirmed under the warranty, we may, at our discretion and where permitted by law, provide one or more of the following remedies:

  • replacement tile or tiles;
  • replacement pack;
  • repair guidance;
  • store credit;
  • partial refund;
  • full refund where required by law or appropriate in the circumstances.

The remedy will depend on the nature of the defect, product availability, order type, time elapsed, use of the product and applicable law.

Warranty claims must be submitted to info@corklayer.com with proof of purchase, photos, description of the issue and any additional information reasonably requested by us.

27. Damaged goods and transport claims

Damage during transport must be reported according to our Shipping Policy.

If the outer packaging is visibly damaged, the customer should take photos before opening, keep all packaging materials and contact us promptly.

Transport damage claims may require photos of the packaging, product, shipping label and delivery condition.

Please do not discard packaging materials until the claim has been assessed.

28. Product care and maintenance

The customer is responsible for using, cleaning and maintaining the product according to the instructions provided.

Use of unsuitable cleaning products, excessive water, aggressive chemicals, abrasive tools, steam cleaners, solvents or improper maintenance may damage the product and may void warranty coverage.

29. Website content

All website content, including text, images, videos, graphics, product names, logos, layouts, designs, icons, product descriptions and technical content, is owned by us or licensed to us, unless otherwise stated.

You may not copy, reproduce, distribute, modify, scrape, republish, sell, exploit or use our content for commercial purposes without our prior written permission.

30. Intellectual property

CorkLayer, CorkLayer.com, CorkMart and related names, designs, logos, product names, images, texts and branding elements are protected by intellectual property rights.

Nothing in these Terms grants you any right to use our trademarks, trade names, logos, product names, content or intellectual property without prior written permission.

31. User conduct

You agree not to use the website:

  • for unlawful, fraudulent or abusive purposes;
  • to interfere with website security or operation;
  • to upload or transmit malicious code;
  • to scrape, copy or extract data without permission;
  • to impersonate another person or entity;
  • to submit false, misleading or harmful information;
  • to violate any applicable law or third-party rights.

We may restrict or block access to the website where we reasonably believe misuse has occurred.

32. Reviews, photos and customer content

If you submit reviews, photos, videos, testimonials, feedback or other content to us, you confirm that you have the right to submit that content and that it does not infringe third-party rights.

By submitting such content, you grant us a non-exclusive, worldwide, royalty-free right to use, reproduce, display, publish, translate and adapt it for marketing, product, customer service and website purposes, unless you tell us otherwise in writing.

We may moderate, edit or remove customer content that is unlawful, offensive, misleading, defamatory, abusive, spam, irrelevant or violates third-party rights.

33. Errors, inaccuracies and availability

We make reasonable efforts to keep website information accurate and up to date, but errors may occur.

We reserve the right to correct errors, inaccuracies or omissions, including after an order has been submitted, where permitted by law.

We do not guarantee that the website will always be available, uninterrupted, secure or error-free.

34. Limitation of liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including mandatory consumer rights, liability for fraud, intentional misconduct or other liability that cannot be excluded by applicable law.

To the maximum extent permitted by law, CorkLayer shall not be liable for indirect, incidental, consequential, special or punitive damages, loss of profit, loss of revenue, loss of business, loss of opportunity, loss of data, project delay, installation costs, removal costs, replacement labour costs or other indirect losses.

For business, wholesale, distributor, partner and project customers, our total liability arising from or relating to an order shall not exceed the amount paid for the specific products giving rise to the claim, unless mandatory law requires otherwise.

The customer is responsible for installation decisions, site preparation, suitability assessment, project planning, contractor selection and compliance with local regulations.

35. Force majeure

We are not responsible for delay or failure to perform caused by events outside our reasonable control, including but not limited to:

  • carrier disruptions;
  • customs delays;
  • strikes;
  • severe weather;
  • natural disasters;
  • war or civil unrest;
  • pandemics or public health restrictions;
  • border restrictions;
  • government actions;
  • import or export restrictions;
  • technical failures;
  • supplier disruption;
  • incorrect customer information;
  • events affecting production, logistics or fulfilment.

36. Privacy and data protection

We process personal data according to our Privacy Policy and applicable data protection laws, including the GDPR where applicable.

By using CorkLayer.com or placing an order, you acknowledge that we process personal data for purposes such as order fulfilment, payment processing, shipping, customer service, fraud prevention, legal compliance and marketing where permitted.

37. Communications

By placing an order, you agree that we may contact you by email, phone, SMS or other contact method provided by you for order-related purposes, including payment, delivery, customs, support, returns, warranty and service communications.

Marketing communications will be sent only where permitted by law and according to your consent preferences.

38. Electronic Complaints Book

For customers in Portugal, CorkLayer provides access to the official Electronic Complaints Book where required by law.

39. Alternative dispute resolution

In the event of a consumer dispute, the consumer may contact an Alternative Dispute Resolution entity.

Nothing in this section limits any mandatory consumer rights.

40. Governing law

These Terms are governed by the laws of Portugal, without prejudice to any mandatory consumer protection rights that may apply in the customer’s country of residence.

41. Jurisdiction

For business, wholesale, distributor, partner and project customers, any dispute arising from these Terms or from a purchase shall be submitted to the competent courts of Portugal, unless otherwise agreed in writing or required by mandatory law.

For consumers, this clause does not limit any mandatory rights to bring claims in the courts or forums available under applicable consumer protection law.

42. Changes to these Terms

We may update these Terms from time to time to reflect changes in our business, products, services, legal obligations or operational practices.

The version published on CorkLayer.com at the time of your order will apply to that order, unless mandatory law requires otherwise.

Continued use of the website after changes are published means that you accept the updated Terms for future use and future orders.

43. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will remain in full force and effect.

The invalid or unenforceable provision will be interpreted or replaced, where possible, in a way that best achieves its original purpose while complying with applicable law.

44. No waiver

If we do not enforce any provision of these Terms immediately, this does not mean that we waive our right to enforce it later.
